Default A Jailhouse Wedding

I got married to my husband while he was still in county jail. We got married may 28, 2010. We had planned on getting married but were not even officially engaged when all this happened. But when he asked me we actually thought he would be getting out of county relatively soon, but we didn't want to wait. After all it's not the ceremony, or where its done, or who is there, or what you wore thats important, it's the marriage, right? I thought that it would be awkward but it wasn't. It was certainly memorable! And it was sweet, and loving, and endearing, and the best decision I have ever made. And now that we found out august 26th that he has to go to prison for a year, we are both so glad that we followed our hearts and decided to do it then! I certainly dont think its a good idea to marry someone just so you can visit them, but if you know that he is The One, why wait? Love is love. And God doesnt care where you have the ceremony, as long as you do it for all the right reasons. The only hard part was not being able to touch, or kiss, as it was all done behind glass, and over the visitor telephone! Lol! We had a friend come in and perform the ceremony for us who is ordained, and my husbands best friend stood in as both his best man and my Man-Of-Honor! Some people didn't like it, but I wouldn't change it for anything. As my husband Nate likes to say, and everybody should take to heart, "THE PEOPLE THAT MIND DON'T MATTER AND THE PEOPLE THAT MATTER DON'T MIND!!!!!!"

thx, jimmys wife
Am new to ALL this,& shy, too, so pls bear with me..are there "rights" w/common law,is common law marriage even recognized by the system? My guy & I took 2 "Friends" to the Beach, the night b4 he went in, & WE had a ceremony between us & our Maker..WE are married in OUR Hearts..but doesn't seem to matter to the system,& We are both concerned about where he is going, & he has some health issues.. Meanwhile, the "friends" have been horrible to me, I don't think they'd even vouch for Our ceremony,at this point. Would appreciate any info about "common law" & "man's law".. I am also looking into marriage by proxy. Thanks,ALL!

I have attempted to read through all the forums and I am 100% confused - I need a little help or guidance! I am in Williamson County - my boyfriend is in San Saba Unit in San Saba - if we are thinking about getting married by proxy - what is the first step that needs to be done. He mentioned something about papers that he needs to sign and I've got no idea -

Can anyone help me...
Please!

Thanks!!

My husband and I just got married by proxy on 12/28 and for us it was fairly easy but you need to have patience. I actually found the paperwork online through the county clerks website. You have to look for absentee marriage paperwork or something like that. It gives you all the steps. You send it to him, he takes it to the law library and has it notarized but make sure everything is filled out completely or they wont take it. You need a copy of his offender ID & birth certificate. The go to the county clerk and get your license then in 72 hours take your proxy to any judge that does the marriages and your done in a matter of minutes. Its easy to do but just make sure he fills out everything on the paperwork, thats the most important thing......Hope this helps

The info you got above my post is correct; I got married by proxy last year and it wasn't all that hard and it didn't take long at all; a copy of his birth certificate and his prison I.D. was all I needed and I actually got the forms on-line; I'm in Dallas however. I posted to say you will get faster answers on PTO for any TDC related issue if you scroll down to the Texas Forums as opposed to posting here. We Texans are pretty territorial and pretty knowledgeable as well. Good Luck...Marcia

Yes you need to get his birth certificate but not his S.S. card; just goggle and down load the Texas Absentee Marriage Form and follow the instructions there. Once you obtain the form it will tell you how to proceed. You need to do this NOW like yesterday b/c it took us about 2 months from start to finish and February 6th isn't that far away...Marcia

Actually, Texas has NO residency requirements. You can just go there and get married.

Was married 2 weeks later by a wonderful judge in Galveston County - 50.00 did it at his home in a little gazebo...

7 months of marriage----PRICELESS

Couldnt help myself. Galveston County is the easiest county to get married in - So I have expierenced....

Also had a hard time finding a judge who believed prisoners had the right to marry.. I called 7 in Walker County - 10 in Harris, 5-in montgomery and 2 in galveston all REFUSED except this sweet little judge

If you need any more information PM me and Ill be happy to help......

For out of state marriage - they need the same thing as if you lived in the state of TX..... helped a friend of mine do it recently....
I am currently in the process of marrying the love of my life, but TDCJ seems to really drag their feet in these matters. Is there any infor you can give me to help out. PM if you can help. thanks

As answered in another thread

Quote:
To answer your question, I suggest you contact the warden’s office of the facility where he is being housed. They will tell you if marriage in that facility is allowed. If they say it is allowed, but you have to supply a chaplain, justice-of-the-peace or other officiator, then ask them supply you a copy of the policy. Your chaplain should then be able to assist you make the arrangement.

Congratulations and good Luck!!!!!

Bunny, I'm a little confused. What are you waiting on approval of? You don't need approval by TDCJ to get married.

So I plan on getting a proxy marriage to my fiance within the next 2-3months and I'm lost. I am in Virginia and he is in TDCJ. Which kinda makes things hard. How would I go about getting the proxy info? Would I need an "absentee" proxy form for both of us? Proxy marriage is not vaild in VA but is vaild in TX.
I'm lost and confused on this as everyone seems to be in different counties in TX, as I am out of state! Someone help?!?!?!? Please??? **whimper** **puppy dog eyes**

Okay, here's a stupid question. I have the Affidavit of absence for a TDC inmate so we can marry by proxy. One of the questions is if he is delinquent in child support. Well, he is since he has been locked up for four years, so the question is: can we still marry since he does owe child support? I have searched all over the internet and cannot find an answer. The county websites are not listing it as a reason to prohibit marriage but I don't know. Please help.

I have my fiancee' power of attorney. What he was told by the clerk is the federal law has changed. It is a paper that he signs with the clerk. No imate has to get anything noterized anymore. But you have to have that paper.

I believe Texas is one a handful of states that allow marriage by proxy. I can't answer your questions, but there are otheres here that are familiar with that process. Welcome to PTO!
