Default What would u do ? Would you take plea deal?

well i am a 42 femaile who is going to prision no matter what ,, i do

i am not a crimal or do drugs or drink , it is my driving that has got me going there for driving while barred

i been to jail once 3 yrs ago and it was not fun at all

my x husband ratted on me and then the following week my daughter said
she need my car real bad and so i had to go take it to her someone ratted on me again for it so i got two charges of dwb the same month
one i had to do 90 days the other i got two yrs hanging over me
i was doing realy good till this last yr i got pulled over in jan
and then i said thats it i never drove again ,, till may when my son came over and i took his car to find my dog who ran away got caught again
so here i go 2 charges again which i am still waiting trial on ,,


welll there offering me a ple deal were if i plead guilty and do 2 yrs in prision they will drop the one charge and i am working with my other case to see if they can run it concurrnent with this charge and do the 2 yrs

now my lawyer says the most i will do is 7 months
how does that work i never been to prision so i have no idea how it work s

and if u were me would u take ithe plea deal or no??

remind u i have 5 d w b on my record since 2005

i am not sure what do ,, i am not married
my kids well my son might support me when i go other then that
i don;t' have realy anyone to be there for me when i go
i am scared as hell to go but yet i want it done and move on

thanks for any adivice at all

my advice would be to take the advice of your lawyer provided he/she has been upfront with you so far and you have a trusting relationship. It seems that taking the deal might be your best option... get it done and over with.

I think that if you know you are going to prison then you can get ready. Save money, have your family get a local cell phone, print the phone form, get addresses. I'm sorry that you are dealing with this.

Basically in Iowa if you are sent to prison you go to Oakdale. That is where they classify you. Then you would go to Mitchellville, Mt Pleasant womens unit or you would stay in Oakdale. But in Oakdale if you don't have a mandatory you would have your time cut in Half. So 2 years would be 1 year.

Advice, Stay to yourself, don't borrow ANYTHING from anybody. Do your time. Get involved in any programs that you can.

i gues my main concern is how much time i will dp

my lawyer says 6 months top
how do they figure that ,.

there is no madiotry on dwb charge bc it is a missd

it is not crimal at all
and the next ? what is prision like ,,
a dorm or what is there more freedom then jail
time in county

i can handle the 6 months but not just sitting in a cell
and doing nothing

and how do i know were i am going

I too, am sorry you have to go through this. I would be scared sh*tless! I don't have too much faith in lawyers, as Jeff's lawyer told him he'd be out in 10 months - we just received a parole board review and it will be at least another year. However, if you've never done time, watch your P's and Q's and yes, get involved in any programs like SaraTony suggested, I don't see why you would have to do much time at all. Once again, this is the DOC - no promises, things change and don't go as planned. I didn't mean to be a bummer, but you need the truth - Good luck to you and God bless you!

ok let me get this straight i might have to do the 2 yrs
first time in prision i am working right now and will have job when i get out
why would my laywer say 6 months total

when it is not true ,, i do trust my laywer very much

so when u say all he would have to do is 10 months and he has to do more can i ask what is he in there for is it a state or fedral prision he is at
and how much time did he get

My brother's atty lied to him BIG time!!!!! He told him that he would sit 6 months... and then when he got there, there was a min/mand of 18 months..... be careful as to who you trust... not to sound paranoid, but if you have a court appointed atty... I would be leary....

Viking, Jeff violated his probation on a 3rd degree burglary charge by drinking and he's not nice when he drinks. He received his full 5 years but the most he will do is 2 1/2. He is at Fort Dodge Correctional, a State facility. He's been down before, so I figure the Parole Board thinks he hasn't learned his lesson. He is also 48 years old. I think they tend to give the younger guys more chances. My opinions only. Anyway, I'm not whining because he did violate his probation and the law is the law. My concern is that he needs to be involved in a recovery "setting" and it is not available in the manner an alcoholic or addict needs it. I'll stop there because I could go on forever. Tarclay is right - be careful who you trust - it is not up to your lawyer as to when you are released. I'm not sure how helpful I can be, as our situations are very different. I would hope someone in this forum has had experience with a situation similar to yours and could give you some insight. I'll pray for you! In the meantime, continue to correspond on this site - it has been very helpful to me!

I guess that if they are offering a deal then take it. Besides, like others said its not up to the judge or lawyers your exact release date. But just keep to yourself & don't let others get into your business. But at the same time don't be snotty. Cuz that could come off as you trying to be better than the rest.

thanks guys for some info
i asked my lawyer about manitory time
he said it doesn;'t apply to my case bc i am not a crimal it is missinery


agv missidemer

she said the manitory sentence is for people with seriese crimes
how do i find out who is telling the turth and who is not
i don;'t want to go in thinking i can do six months and find out
i got a yr or 2

how does it realy work i know it cuts in half the mint u walk in
but don;'t u get good time taken off to
so that should be a month or so

i just want to go in aug and be out by next summer thats my plan
first time in prision don't; have any other record no drugs or drinking

this is my only charge i got ,,
