Default Add three days to his time because of victim notification? UPDATED! They added MORE!

My husbands release date was October 11, he was granted 30 good days back so his new release date should be September 11th right?

Well they just sent the notification off to his victim on August 1st. They are telling him it is possible he will have to stay till September 14th because they have to give the victim 45 days notice before he is released.

I know its CDCr, and CDCr can do what ever they want (well that was my husbands answer to this question anyway)

Does this sound right?

I know why quible over 3 days.......but 3 days is 3 days!

Yes, lost credits can not be restored if they will make the inmate overdue for release or do not allow for all the appropriate notifications, including victim notification. Usually the classification committee will inform the inmate that Records must complete all notifications timely and that may impact his release date.

I thought I would share what happened. They added 4 extra days to his time. He is getting out September 15th. The 46th day after they mailed the notification to his victim. So only 30 days left!

Unhappy Adding extra time for victim notification a second time?

Ok so my husbands release time was October 10th, then he got 30 days good behavior back and it was changed to Sept 11th, then they changed it to September 15th because of victim notification. Now he was just told on the 2nd that it is changing AGAIN to October 10th because of victim notofication again. Can they do this? Plus he is high control, so they cant release him on a Friday. So the date doesnt even make sence. Any clue to what might be going on will help. I plan on calling his consulor and records on Monday.

No one has any information on this? How can I make sure they have notified everyone they need to and dont do this again in a few weeks?

Default Another update!

The victim moved! So they have a right to extend his time so that they can notify them again. I still dont know when he can come home. Does anyone know if they release people on Columbus Day if they are on high control?

well here it is a week later ,and still nothing. I cant get any help from anyone at the prison, i just get passed from person to person. the Ombersman even sent me to some one else. his father was called and told a lie that he was given another 115, and that is why it changed, but when i spoke ti my husband today, he had not been given any 115, and no one has spoken to him about this all week. i really dont know what to do anymore.

I have contacted the Ombudsman for the prison he is at AGAIN, in hopes of finding out more. If i dont hear something from her, then I will go to the Cheif. Thanks for the advise.

Default Tired of the run around!

Spoke to his councelor yesturday, she said he will be released Oct. 12, but couldnt tell me why his date was changed because "that's not her department." His official paperwork notifying him why his date was changed just says "transaction deleted." no reason is stated. I called records today, and they told me " I cant tell you anything your husband needs to request it." My husband told me he cant be released on October 12, because October 13th is a CDCr holiday, so it would have to be the 13th! I now understand why the system is so crouded! They wont let anyone leave even when its time for them to!

Default You go high enough up you get answers...well some!

So I emailed the Chief Ombudsman and complianed that no one was helping me, and I got an email from the Ombudsman incharge with SOME answers. Apparently the 30 day credit he "isnt allowed to have" because of some reason they wont really tell me. Still havent been told his EXACT date yet, either the 12th or 13th! Apparently my husband will be given a meeting wit the head of the records department tomorrow and will be told what is going on. I just hope that what I was told today wasn't another run around to keep me quiet like all the others.

Glad to hear you did go to the Chief, and at least got something. Good for you for being persistent!

Well because of lockdowns last weekend so no phone calls, and hubby waiting for stamps in the mail, I just got a letter from him today telling me he was finally told why his date was changed. Because of notification to the parole department and the county he will be coming home to. (still dont quiet get that because they still knew it was going to happen anyway) But he said the lady in records was really nice to him and even apologized for the mistake! But they still have his release date all screwed up. It's now October 11th, a Saturday. Maybe this week they changed it to Sunday, and the folowing week they will finally change it to Monday where it should be in the first place! So I am still waiting to find out when he can come home!

It's official! It took them 3 weeks to do it, but they picked a date and the parole officer even approved it! October 11th, and he doesnt have to report to his PO until Tuesday! Praise God!

Glad to hear that you finally got that settled. My guy was suppose to get ou the date also, but just the other day they informed him he had a extra 16 days now we have to wait until 10/27. I wish you both good luck in the future. Have fun with your guy for the long weekend.
