Default Is this accurate information? His time cut in half?

my boyfriend has had his final probation violation in polk county. why he had it, i explained in another post in "here to hear you", but i don't feel it's important to explain why. we all believe he is probably going to prison to finish up his sentence.

he has a 5 year sentence that got suspended and transferred to probation, so he's been on probation for the last 4 1/2 years. he told me that when he goes to oakdale, they cut his time in half, and he would have to do 27 months. however, he has about 24 or 25 months credit through jail time and halfway houses.

so is that true that they really cut their time in half?

SaraTony informed me since he has such a short amount of time it would be easier to discharge him.

so my next question is, is that what normally happens when a convict has less than 90 days left on their sentence? do they usually get discharged or is it more common for them to finish the 90 days?

SaraTony don't worry, i appreciate your response, i'm just one of those people who likes to hear a lot of opinions about something thank you again for your response, though.

anywho, i'm just super curious. if he got discharged, that would be amazing, if he had to finish the 90 days, i can wait that short time....i'd just like to know what you all think.

Don't worry Sari. I completely understand the whole want lots of info thing!!! My guy friend was just transfered to Anamosa from Oakdale with less than 90 days to go. So it does happen. Tony was telling me of a guy that came back with less than a week to discharge.

Discharge is when they walk out of prison FREE!! No paper or parole to deal with. If your man has been on paper for 4 1/2 years discharging would be the way to go.

From my experience, once you violate probation you don't "finish" your sentence. You get the whole probationary period. Then, it is cut in half. Jeff violated about 3 yrs into his 5 year probation. He got sentenced to 5 years with a TDD date about half that. He's been gone nearly a year, and no parole board hearing until June, 2009. Good luck kid, I hope you may be an exception, but if Jeff only had to finish out his "time", he would be home any day! Kelly

oh my goodness this stuff is so confusing lol!!! ok so...he has 5 months left on his probationary period. so he'd be only doing 2.5 months?? or am i confusing myself again??

ok since he has been on probation for 4 1/2 years that does count towards his time now if he picked up a new charge that would be different. yes it is easy to discharge but it would be hard if they let him out to discharge on the street since he has been revoked on his probation. most likely they will keep in at oakdale. and they will let him know his discharge date also you can check on iowa dept of corrections website and that will tell you everything you wan to know

thanks dewife...yup you're right on that one, luckily he does not have a new charge and he will only be gone for 2 and a half months.
