Exclamation Grievance against guard

My son filed a grieveance against a guard last Sunday, 9/29, for being way too thourough when searching him after my visit that day. He has had trouble with this guard before, who seems to really enjoy the search of his private areas and spend way too much time on it. He is a minimum security inmate at H.C.F. but as soon as he took the grievance to the unit team he was taken behind the walls and placed in segregation. He had a review on Tuesday 9/30 and was told he could be placed back in the gen pop but was again taken to segregation and told only that the investigation of his grievance was not complete. The guard refused to take him to his next review which was to have been on Friday. He is in a cell with a concrete bunk, it took them two days to give him a pillow and another day to provide a blanket. He has never had any disciplinary write-ups or been in any kind of trouble but it certainly seems as if he is the one being punished here! He has gone from min security to only being allowed out of this single cell one hour a day. What, if anything, can I do to get this taken care of. HE is not the one who should be in trouble here!

About all I can suggest is to call his unit team and ask questions. Don't try to argue his case, but be nosy: is he in administrative or disciplinary segregation? has he had a hearing? if not, when is his hearing? how long will the investigation take? is he in protective custody? etc. etc. [see IMPP chapter 20 at http://www.dc.state.ks.us/kdoc-polic...pp/chapter-20/ for information about segregation procedures ]

It may be enough just to let them know that somebody on the outside is watching his case, and watching to make sure they follow their their own rules and standards.

Good luck to you both!

Thanks so much, Chronistra! I want to help my son but am new to this and so was unsure what to even ask. Your post helped a lot. If I call and ask for his unit team will I get the team where he is now or the team in the minimum security area where he has been for the last four months? Does it matter?

I don't know; it will probably be the one in seg, but I don't know that it matters particularly.

It sounds like your son is basically alleging something like sexual assault, so I & I (Intelligence and Investigations) is supposed be doing the investigating. IMPP 10-105 may be helpful--it primarily covers inmate-on-inmate situations, but is supposed to apply in all instances. (If nobody wants to talk to you, that might be a worthwhile topic to slip into the conversation.)
