Default Appeals Process Questions..

How long of a time period have some of you encountered for your first appeal with the state? I'm trying to get an idea of how long it will take for the state to hear our appeal. Our appeal is for the severity of the charge and the sentence time. We have already been assigned a state appeals attorney Or would it be better to get another private attorney. Would this speed up our appeal time frame already told to us?
She told us 1 year for the appeal.

Thank you very much for reading my post..

We have already been assigned a state appeals attorney What does the appellate lawyer say? He or she knows more about the ins and outs of this particular court in these particular circumstances than anyone who is likely to respond to your post in this forum. Or would it be better to get another private attorney. There is an understandable tendency for people caught up in the criminal justice system to distrust all the players, including defense counsel. Nevertheless, an experienced public defender will often do a better job of representing a defendant than private counsel, simply because the PDs know all the players and may be expected to dot all their i's and cross all their t's--and that, sad to say, is what it's all about at the appellate level. Forget about getting justice there. Appellate courts review procedure, not substance. Would this speed up our appeal time frame already told to us? Almost certainly not.

My pleasure. By the way, PTO is a great place to get support and encouragement. It is not such a great place to get legal advice.
