Default Does anyone NOT know when their man is getting out?

I'm usually pretty optimistic but I think tonight I am having my first official break down

My boyfriend claims that he can petition for early release - under a Wisconsin law, act 109... basically saying you can file for early release after serving 75-85% of your sentence (He's in Racine in Sturtevant) - which would allow him to get out in APRIL instead of SEPTEMBER, giving us the summer to be together...

I just did some research and it seems that only a very small percentage of petitions are granted, about 30%, so the odds aren't in our favor

He tells me he will get it, because it's his first crime, and his sentence was only 2 years to begin with, and because he's so smart (was a med student) and because he's behaved..

Does anyone else NOT KNOW when their SO is getting out??? It's maddening not knowing!!! I know I have no control over this whatsoever so I should try to focus on the positive but some nights it is so hard

At least I'm not the only one...

Thanks for listening. *sigh*

I feel ya... hubby could be out in 7 years, 9 years or his full sentence of 12 years. I don't really worry about it too much... the important thing is that they can't keep him forever and he WILL be out!

My hubby kind of did the same thing to me. He told me he would only serve 8 months of his 2.8 year bid, but lo and behold is is actually serving 16 months of it!! It took hubby awhile to finally tell me the truth because he knew how heartbreaking it would be.

All I can say is..... Hope for the best and expect the worst. Just try not to get your hopes up for the early release. I am sure we have all been there, done that.

Just expect him in September and if he does call you to pick him up early, then you have a wonderful surprise!!

Good Luck to you both!!

i feel you girl!!! my hubbys release date was oct. 8, now they are saying OCT. 20, but he has to go back to court on thursday the 16 which is 3 days from now, to try to get the diversion program knocked off his sentence cause the judge maxed him out and gave him 2 years plus 4 and a half months of the diversion program, so i know exactly what you are going through but hang in there and remember PRAYER CHANGES THINGS!!!!!

Well they all think they are getting out early. My husband has been in for 8 years now and he still thinks the new laws they are passing here in KY will set him free sooner. His serve out is 2015 and he surely wont be served out. He has completed every class done everything they have asked of him to get out. Surely next year will be our time.

I know how you feel. My hsuband is serving a 21 to 42 month sentence, he has been in for 22 months now. It has been a roller coaster right from the start. He wasn't even supposed to get state time, only county and be out by Christmas of last year, yeah well the Judge had another idea. We saw Parole in April and they denied him, for whatever reason. He did all he was supposed to and then some, he never got a write up, he held a job, I mean he did everything, still denied. So now we go again in March. But the thing is, the Govenor of our lovely state, Pennsylvania, just put a moratorium on all parole in the state. Meaning, NO ONE can be released AT ALL. Even if they were granted Parole, they can't be released. He is sitting with guys who have the green sheets to go home and can't now because some a$$hole on parole decide to go and kill a cop in Philadelphia. We have NO idea when he will come home. He maxes June 5th 2010, but even though that is not that far, it is still far away. So until the govenor decides to lift the moratorium and even then, the rules are going to change and it should only affect voilent offenders, which my husband is NOT, but still who knows what will happen now. We are just bracing ourselves for the worst. We had real hopes for this time around, but they are quickly turning into looking towards him maxing out.

OH. MY. WORD.

That is an extremely heatbreaking story to read!!! I can't IMAGINE how those guys feel that COULD be out but aren't... that's... there aren't words for that. I would be sooo upset and angry - for the governor to make a blanket movement like that that effects everyone... when it was just that jerks fault. Gosh, stories like these stick with me for days... so just know that others are thinking of you and wishing you the best. Thanks for sharing, it helps to know others are going through tough times as well.

Yeah I mean, I understand that something has to be done by the Governor, this is not the first cop to be killed by someone out on parole, in fact out of the 9 cops killed so far this year, 5 of them were killed by a person on parole. The problem isn't with the inmates, the problem lies with the parole board. They keep the wrong people. I mean why in the hell were they more concerned about keeping my husband who is a non violent offender, and letting go the violent ones. It makes no sense. The parole board is appointed by the governor, perhaps he needs to appoint new people who are better at their job.
I walk with cautious optimism, but sometimes it is just so damn hard to. Hope for the best, expect the worst........
He can still go in front of the board, but even if they say he is granted parole, he can't be let out. Like I said, hopefully it will be lifted by March when we see them. He did tell me though that they are stocking up on beds and barbed wire, so that seems to me, they are bracing for the long haul.

Have you tried looking on the New Jersey Department of correction website. That will usually tell you the parole eligibilty date and the max out date

Ugh, I am so sorry. This isn't the first and won't be the last example of bureaucrats not doing their jobs efficiently.... it's so much more awful though when it's affecting real people's lives so intimately. I feel awful for the cops families, but I also feel awful for all of the great guys and their families who deserve to go home. I wish I could say that you should write a letter to the governor or the parole board, letting them know what you think about their decision making skills - but I think we both know that'd be fruitless...

I really hope everything turns out better than you expect.

The reality of having a loved one in prison is that you will not know until it is just about time. I hate not knowing when I am bringing him home, I hate having to tell the kids all the time, we just don't know. I hate to think that maybe, just maybe, the kids think he did something to be told he can't come home, like he isn't doing all he can do or he isn't behaving himself. I always reassure them that he is doing good it is just that there is no justice in justice system, it is basically an oxymoron ..... lol ..... Not knowing is a horrible feeling. Having to tell our 9 year old, we just do not know if Dad will be home by July to take you to see the new Harry Potter movie ........ the whole situation sucks BIG A$$ ..... ok that was just my little vent for the evening .... lol ... Lets all move along now shall we .......

WOW...well my ex Earliest Release Date is 2045...HE's been in for 7 1/2 years now...His case has been in appeals for over 2 1/2 years and i have NO clue when he'll be home...

Now that the Mayor of Detroit shut down the crime lab, and the Prosecutor has to go and re-evaulate all the cases having to do with Fire Arms...because they found all kinds of errors and know that there are innocent people sitting in jail over a crime they did NOT commit...he's hoping that this will be a way for him to be able to get his case either dismissed or time served.

Trying to explain to my daughter that I don't know when her DAD will be home, but that he loves us very much is by far the hardest thing i've had to do in my life, besides deal with the other BS in my life..

I just look at it as this time apart is helping us know what it is we want in life...
