ok, i have a question. I was harassing Tallahassee again about my guy's situtation and I learned something new. He will hit 85% on 4.16.09 and she said he will stop earning gaintime at this time. What does this mean? Does this mean that this is his earliest release date provided he "behaves"? And what are your opinions on if him getting out this day if he still has no cc's or dr's with all the overcrowding/budget issues? Any insight is VERY much appreciated!

You are correct. That will be the earliest he can be released unless something changes in the legislation.

He doesn't believe he will get out in april because he won't get the gaintime in time???? the person i spoke with today said that after 4.16.09 he will stop recieving gaintime all together because he will hit 85%. i have done the math and all his sentencing and i believe this is true yet he says it isnt possible. oh wat to do now?? be pissy and mope like him? ahhhhhhh this is getting so rough!

He will earn 10 days per month as long as his monthly review is satisfactory. Take the release date he has now and subtract 10 days per month and see how many months it will take to reach April 16. Does he have that long left to serve?

this whole mess in confusing me again. 6.27.09 is his release date on doc's site. he says he doesn't have enough time to hit that april date. he was sentenced to 18 months + 84 which is 632. at sentencing he was given 397 time served. so that bring it down to 235. there are 144 days from 11.24 to 4.16.so thats down to 91 days. 85% of the 632 is 537.2. with is time served at 541 days on 4.16. i haven't factored in gaintime at all on that. this is going from sentencing with the credit time to 7.17. he has recieved 20 days gaintime so far as he was transferred to prison in december he only got gaintime for jan and feb.

so im not exactly sure how to say this but does it matter if u hit 85% by simply serving that much or do u have to hit 85% by the result of earning gaintime? like he says he won't get enough gaintime to hit the april date but when i simply figure numbers with no gaintime added he hits 85% on 4.16 regardless. does that make any sense at all??? lol
