Default Question Re: Expired green card and voluntary deportation

HEllo
Im new to the site and Im surprise at the many women going thru the same thing as me. MY bf is currently in custody at the ELOY facility. He was locked up in SOlano county for an upscounting warrant (?) for not reporting to his parole officer. He is on parole for 3 years for a 2-11 which was a robbery he did about 2 years ago and did 2 years in san francisco county jail. He has a green card but unfortunately is expired. So my question is what are his chances? We are thinking for asking for a voluntary departure but we dont know if they will approve since he is a felon. I dont even knw what to say..pretty much what options do you think we hav?what should i do????? ANything would help and i wanna thank you in advance

It's always best to consult with an attorney for the best information.
You can try checking here- http://www.uscis.gov and search for probono attorneys in AZ. There are quite a few who deal with immigrants at Eloy. Hopefully, there will be someone who can take new cases.
On the surface, I would say that it is unlikely that he could successfully fight deportation. But, sometimes, there are extenuating circumstances that an attorney uncovers while asking you all the questions to get the information he needs.
Regardless of being a felon, if he has not had any previous illegal entries (caught for), he will probably be offered voluntary deportation. That would be his best bet. He will be back in Mexico quickly and able to move on with his life.
However, just to be sure, you should try to speak with an attorney. If there is some small chance to fight it, you need to do it now, cuz that opportunity wouldn't be there later.
