Default ICE Issues! His time is finally over, now for the next obstacle
I have posted a thread in the past when my babe was still in prison doing time...

Well Aug 31 2009 he finished and got moved to KROME Miami (ICE) ... he has drug charges in NC he did time for already and VOP on a burglary charge he wasn't convicted for in FL that he got extradited from NC to FL for cuz he VOPed and just finished that as well.... he was detained by ICE in Sept 2009

...now he's had a lawyer already working on his case trying to withhold his charges in NC (he's a VERY expensive lawyer not no couple thousands im talking bout more or less 40 G's expensive).... looks like his lawyers got a good case going, i guess what he's trying to do is try to eliminate NC drug charges against him because of inconsistent disorganization of the case and only use the burglary charge from FL that his friend placed charges on him for but then felt bad because it was only a fight and tried to drop the charges but ofcourse the state picked up the case but i highly doubt he got convicted for it but i know he got probation for it in i think 2006 which is the VOP i was talking about earlier

...sooo his lawyer is using his bipolar disorder as a weapon for the case because he didnt know he had the disorder until after the burglary charge... my baby's from Venezuela which i keep hearing is becoming more like an asylum country??? is that true? He's a perm. residence since he was 12 and is now 24....

My question is peoples opinions on how its looking so far ??? Above is what I know about the case... his first court hearing was pushed to the 30th of Nov. because his lawyer was still waiting for a response from my babes judge in NC...Me and his families plans like we been doing so far is visiting him and supporting him all the way and going to all the court hearings.... After Nov. his lawyers goal is all of this to be over by Dec. or Jan. ...I'll def. keep everyone posted but for now I want to hear everyones opinions please

..I guess u can say i need support because I'm sooo scared if they deport him I dont think I can leave the country because my sons father won't let me leave the country with my son (he wont sign the passport for him) <~~~ anybody know what i can do about this as well???

I think his only chance is if he sentice is less the 1 year. This is not time served but actually what his sentice is.

40K seems like a lot of money to be spending, hope this lawyer does you well.

GOOD NEWS!!!! ..... but first I gotta correct I was wrong he WAS convicted for the burglary charge he VOPed with and did time with last.... But the good news is that his lawyer dropped his conviction for the burglary charges in FL so now they cant use that on him .... now his lawyer is trying to drop his conviction in NC and if he does they'll really have no reason to hold him but he'll still have a case with ICE (Im guessing) but I just wanted to update the good news

Where is he being held right now?
If he is not in NC...he has a greater chance of NC dropping the charges..I've seen lawyers get sentences dropped, using the he will be deported..thus let him go now!
If you dont mind me asking....who is your attorney or what city is he/she in.
I know a wonderful attorney who's used that..and got charges dropped on several occasions...I was thinking it may be the same one you've got!

Well he did his time already for NC and FL (he did NC first then FL).... he's in FL Glades county jail being held.... His lawyer got the FL convictions dropped (even tho he did his time already) he's not in NC right now and thats basically where he has the worst charges tho (drug charges) IM PRAYING... i dunno what to do i cant leave the country

His lawyers from Tampa FL we live near Miami FL he flies out for his court dates and meetings with him ... his last name is Aurturo i forgot his first name ... he's very good and very $$$$$ may i say... but anything to keep my baby here cuz it will be such a battle with my sons father to leave the country and i really dont wanna raise my son in another country u know?

Ok I got a text from my babes mom saying that he's not having a hearing Nov. 30th She didnt give me much details but I asked if it was bad or good and she said it was alll good and to call her later tonight for details sooo now I gotta wait til tonight!!! I'll keep everyone posted

OK!! =) I spoke to his mom and the lawyer found a mistake on their part in NC during trial and his lawyer is going to use that to vacate his charges in NC ... sooo thats why he cancelled Nov 30th because he put in a motion to do the same thing he did with FL and drop the convictions!!! soo we might not even have to fight this case because with both convictions dropped there is no case he has his residency =) his lawyer said everything is looking very good for my babe and that he might be walking a free man HOPEFULLY before Christmas!!!!!!!!!!!!!!! LETS PRAY!!!!!!!! (his lawyer went from thinking 50/50 chance to 90% chance he's coming home!!!)

Thanx everyone lets keep our fingers crossed I'm so excited for him to come home already!!!!!!!!! its gonna be kinda wierd because im used to him being away but i'm def. ready for him to come home and that might be sooonnn ... that would be the BEST Christmas gift!!!!!! EVERRRR!!!!!!

Ok January 6 is his next court date and its pretty huge b/c it determines if the charges got dropped and he'll come home that day or we have to fight the case and wait for another court date a few weeks after .... PRAY FOR US

THEY VACATED HIS DRUG CHARGES!!!! THEY ERASED IT!!! Now we can X those charges out and now he'd be eligible for bond but first his lawyers trying to do the same thing with his charges in FL .... soooooo we're looking at next month he'll hopefully be home!!!!!!!!!!!
