Default Would getting married while he/she is incarcerated help them stay in the country?

My fiance is in Mira Loma in Lancaster,CA. We wanted to get married but I was wondering if it would help? Even a tad bit? We have a 20 mnth old son together? This is his 2nd time bein detained by immigration. Wats da possibility he'll stay?

Maybe. But my husband was a green card holder and he's still going to be deported after his sentence. I have heard we can fight it but I don't see the point.

Wow. Yea he went in for possesion of a fire arm and was sentenced to 90 days which he already did but he had a hold so he's with immigration. My man decided he's gonna fight it. Best of luck!

I didnt exactly know where to post this but i found some good news and would like to share it with you ladies.
My fiance has a immigration hold and were looking forward in fighting his stay. however, we can not afford an attorney.
so I went searching and i found some attorneys that do non-profit work. I believe its has to do something with the pro bono program. anyway i am listing the list here for any of you see ladies seeking help.

I hate to say this but.... Marriage after incarceration doesn't help. When Marcos first got locked up I went searching through law books trying to find a loop hole and I came across this. I have been married for 4 years been with him for 9 and this is Marcos' first time dealing with Immigration and that didn't even help.... I'm sorry... You don't know how bad I would like to tell you that it would. I will try and find the site I found this on originally... and link it on here.

Oh man. SYNTHEA wow it seems like were in da same situation. My son hasn't had his dad for 3 months but it seems like more. Its tough but keep ur head up. And vannaabernathy I'm glad u were upforward, I never had my hopes 2 high but I wished there would be somethin that would help. All I or anyone can do is pray and hope everythin goes well.

hi ladies... its nice to hear some of the same situations. my husband is in mira loma right now fighting deportation. he actually had committed his crime over 13 yrs ago and did his time and probation and 13 yrs later they decide to stop by and pick him up:-( it was so unexpected and tramatic to all of us. we had no idea this was going to happen. he has only been gone for a month but it seems like forever..... i probably sound like a BIG SISSY! i have actually been married to my husband for 6 yrs and it did not make a difference in his case at all! we even have 5 kids. the only way they will release him is if we can get his 13 yr old charge vacated.... we will find out on tuesday. wish us luck we need all we can get.

How is it like being in a detention center? I think since my fiance is in calipatria state prison he will be in Imperial detention center right? I was told the wouldnt reveal any information once he gets to that detention center only with his A number.

Im just really nervous and i want to be prepared to wants to come.
Can They make Calls? Often and when? How must do they cost?

Any info is greatly appreciated

Ya I had a feeling that marriage wouldnt help out too much, I wanted to try, we still plan on getting married, but waiting until he's outa prison will be better if it's not going to help at all.
Hey those free lawyers, it's the best way to go if you dont have money to put up front. Rudy Cardenas was the one my man had the first time he was in the El Centro detention center, he actually helped him get free from deportation, then, lets just say, wrong place wrong time, brought him back to all this again, and the second time in that same detention center and they said he had no luck in winning the case so he voluntarily deported himself.
Hey about the detention centers, they are actually better than I thought, when it comes to treating the guys who are in there better, and feeding them better, they get much more privledges, I actually felt like it was much more better than him being in prison, it was more like a holding center from one place to the next. So ya, not too bad, they get to buy phone cards inside to call you, so no more accepting collect calls, and ya I can remember the place fed them much better food.

well its great to know about those phonecards..
Because i hate collect calls. but it doesnt matter as long as i get to hear his sexy voice, it makes everything better.
about Rudy cardenas Im going to look into him, and did he at least charge you with a consultation fee or something?
i dont know if i should get going and call some attorneys yet or if i should wait. My fiance told me he was waiting for an immigration person to come talk to him about the ins hold being put on him in prison. How does that go ladies? I Have a question, if my fiance has a baby with me but is not listed on the birth certificate as the father and has his last name still can that still help him.? i cant add him to the birth cerficate until he out. but i surely can provide them with a dna. lol. cause thats his babygirl.
the reason why i didnt add him or let him sign was because i was only 17 and he was 22 at the time. and i was scared i would get him in trouble and catch a case for him. and i didnt want to do that. what should i do about tthat situation? Can a copy of my baby certificate help?

It Breaks my heart to say or should i say type... but there is NO WAY of him getting away with it..... ive been threw it all of last year in sept. tried everything posiibly and nothing.... now i live in a RUT... i have my 2 kids that wont get to see there father any more.. and the judge could care less if you your dying!!!!!! Aww well he has court nxt wed. So I'll have to see what happens. But thank u so much ladies. All this has really helped me. I'm a tad bit upset but hey I dnt expect more or less of da situation. I dnt have my hopes set all high. I know what to expect. But thanks again ladies..

Okay quick little update for a search for an attorney. Well I got to speak to Rudy Cardenas Partner he also is an attoreny, he mentioned he has worked with immigration law liittle over 30 years. He said that to get started on my fiances case he would need 1,000. And later another 1,000. but its not determined if he has a chance to stay.
Soo.. I dont know what to do. So should i go for it, even if he said he wasnt sure? or wait for my lucky strike? ugh! this makes my stomach feel upset.
i wont talk to my fiance till well friday and 2,000 is pretty much all i have. I am 19 year old single parent for a minute working full-time and going to school. Its streess me out!
I dont know what to do!
As for him currrently hes still in calipatria prison waiting to speak to someone about his ins hold. he has 23 days left and he hasnt spoke to no one.
How long will it take? When is it over?
I terrified of having my family seperated. This is all i have...
Another thing one of my fiances charges he was convicted of was a felony failure to appear. though however He was only sentenced to eights months only and The attorney mentioned to be considered a aggravated felony you have to be sentenced to over 2 yrs. Does any one knoew about this?

Well he is still serving the rest of his 20days right now in calipatria state prison. He is waiting to speak to some immigration officer about his hold. Perhaps i think they are interviewing him. He dont know when exactly he'll go to court. But this is indeed his first time with immigration. he will indeed continue to fight not to get deported. Hes never been or i shouldd say returned back sice he came to the us in 1990.

No, getting married does not guarantee a stay from deportation. It depends on the classification of crime committed. Does he have a green card? How long has he lived in the US? Prior to his arrest was he a productive citizen?

He does not have a green card. The reason he's detained again was because he got arrested for possesion of a fire arm.
He did his time for county den got an immigration hold.
Before he got into this problem he has very productive. He was actually workin at a In-n-out which pays really good and all got screwed with this problem.
I mean he's doing his best now and stayin outta any trouble. I'll just have to wait and c. He has court wed.
So time will tell.

first off, your attorney is an idiot. Any felony, aggravated or not, is considered deportable if the verdict is over 365 days! (ask Pamela with her nephew's 365+1day sentence.) ANY aggravated felony crime is deportable. California is a little more lenient than other States, but nonetheless, you'd have to show some extreme family ties, hardship, or something other than having a child. INS doesn't give a rats ass about family or assimilation or just the fact that you don't even rememeber your native country. You are illegal and violated the law. And after, the lawyers' get their cut.

Well I mean if he were to get deported he understands he did this to himself because he went out and commited the crime.
But I'll just have to wait and see. Thanks for all the advice and the support.

hello everyone i'm new at this but i have a question my loved one is going to federal prison he got sentenced 4-5yrs he has already done 10months in jail so that will go towards his time, he is a resident alien, when he got sentenced the judge said there is possible deportation this is his first offense will he get deported or does he have a chance to get a second chance? Also is there anyway to know if he wil get deported other than waiting till the day he gets released from prison? Please someone answer i'm so desperate please . thank you
