Default Is it worth it? Cost of Transcripts

My baby got his first appeal denied! and now we are looking forward to his second step up..and so now i have to get his court transcripts..however they gave me a quote of $500 dollars for his transcripts because they are 5 volumes long. They charge per page and the lady told me that it was already requested...which makes me wonder who has his transcripts..probably is first lawyer! hmm so i wondering do you think the price of the transcript is worth it?

my baby has life in prison with out parole for a crime he did not do! they would call that. "Miscarriage of justice" which is hard to prove, but me and him are not giving up.

I would talk to the lawyer he had to see if that was who had the transcript. To me 500 is alot of money and maybe if the lawyer had them, they might let you see them or even buy them from them cheaper. But thats just me.
Good Luck on the appeal.

My babys 1st appeal got denied too and his lawyer had all the transcripts and I got them and didn't have to pay anything. Check with the lawyer 1st because they should be able to give it to you with no problem especially if it was a paid lawyer which thankfully my babys was. If not I would say, anything that can help his case out is priceless. I would pay whatever I had to if it would help him get out sonner. Money comes and goes but his freedom is priceless. I know thats crazy to say in these hard economic times but I dont care. Oh and by the way, those trascripts are like textbooks, I can see why they would cost that much. Well good luck honey, I know how it is. We are working on his 2nd appeal and supreme court hearing now. Ugh, so frusterating.

If it could help, yea, it's worth it. We paid a couple hundred less. Hasn't helped yet but it might @ some point. That is, if he's not released first. Good luck!

I would check with the lawyer first and see if there is any other way around it.

My baby requested his and got them for free, maybe he should request them to see what they say. Because they know he doesn't have the money to pay if he's locked up.

Life in prison without parole VS $500

Easy choice for me.. I know its a lot of money, but in order to fight this you're going to have to sacrifice some things. Especially if he's innocent!! Good luck!!

Sometimes you can ask the county clerk to view the file for free. Plain copies do not cost much but if you plan to use them in a legal action you will need certified copies which cost more. Most records are now available on the clerk computers to view. Often getting just the pages you need will be a lot cheaper.
If the record has not been transcribed for the file it gets costly and it is often impossible to select what part you want transcribed.
The attorney may be able to get copies for free or at a reduced price.
I know from my own case that what the judge says is not always what the clerk writes down so the only recourse is to get the record transcribed. However if you were to write the judge and inform him that his instructions were misquoted in the file he may order a transcription himself to get the record straight. In WA the judge has 90 days to correct the record without bringing the defendant back to be re-sentenced. If he corrects the sentencing document a copy will be sent to him by the court.

tea my hubby is doing life also...he's working on his case..we contacted the court and they wanted like 490 for his transcripts..those things can be a 1000 pages long or longer...but hubby said there was something he did to get them for free b/c he's indigent...But Check with his trial lawyer he would have them. That seems like alot to pay but u cant put a price on their freedom...I'd pay anything to get my hubby home..

Default Transcripts

He can request pretty much all his information from his court dates from the FOIA--- Freedom of Information Act you should be able to find yours locally. That is what we had to do. I also went to our County court and request to review his court file, you can look over all this and copy what your looking for. theres a cost but I know it's not as high as the $500.00 quote. I just had some copies I think I paid a total of $12.00 for maybe 50 copies. But those may be some options. Hope that helps.

Reviewing and getting copies of printed files is always inexpensive. However transcripts are voice recordings from the trial and need to be transcribed by a clerk into writing. That is why it cost considerably more. It is only useful when statements were made by witnesses that are not on the court files would be of value in an appeal and also to clarify the judges orders that may have been documented incorrectly. Challenges to the judges decisions on introduction of evidence may be only available in the transcripts.
Wouldn't it be nice if audio recordings could just be run through a voice to text software program. But they need to be certified by the clerk to be admissible in court. Transcripts must show who said what..

The first time round, I pay a few thousand (6,000). This time, I just don't have it, so we are filing for indigent status and hopefully will not have to pay as much!

If you are indigent, and have a statutory or constitutional right to an appeal or post conviction proceeding, then you will be entitled to the transcripts at state expense.
