Default Average Length of Processing Time for Deportation after sentencing?

Does anyone have an approximate length of time it takes for deportation processing once a sentence is completed? My guy's sentence will be complete on August 8. He was here legally, with visa and green card, but he did commit an aggravated felony. He has never been deported. Does anyone know? 4 weeks? 6 weeks?

Well first he has to be transferred to an ICE detention center then I believe they have 90 days to ship him out. The actual length varies by detention center, country he'll be deported to and how fast they work at the detention center. From Georgia it tooks us almost 6 weeks to get deported to El Salvador and an other group that went in the same day as my hubby left two weeks before him.

im not sure... my bfs release date is aug 18th he already got a letter asking for him to send in his passport, birth certificate, and any other national identity. He thinks for some reason he will be in the Dominican Republic by August 18th. If you find out anything more let me kno.. even let me know what happens in august. Thanks

Well, if you send the documents it makes the process faster.

As everyone else mentioned, it varies. The DR really just depends.

Once he gets into ICE Detention the clock starts. They do have 90 days maximum. I read a lot of people say thats true and not true but I have to say, its probably true.

My other half got taken into custody of ICE towards the end of last may and was back in El Salvador on July 27, if memory serves me right. Anyway it was 80 something days, so they stretched it out to the min. There were people that went before him, so it depends. He was waiting 3 weeks on his passport according to ICE, so if you provide that it should make the process a lot easier.

If his release date is August 18th he isnt going to be in DR on the 18th. Rather you tell him that or not is your decision. If he is released on the 18th of August I'd say best case scenario.... Mid September. Worst Case: First of November.

Either way, take a sigh of relief, the worse is almost over.... it's coming to an end.

thank you for your help... Now im worrying again bc he doesnt know where his passport is.. all we have is his birth certificate. Before he was arrested a police station had called saying they have his passport and permanent residence card but was never able to go get it and it was 5 years ago. Can he travel with just his birth certificate?

Kim78 & Luis84,

Thank you for the response. The U.S. government took his passport 6 years ago and we have not been able to get it back (same boat as zapato). He does have his birth certificate. I can't get another passport for him, can I??

zapato and jahlove -- no. Getting another passport would be impossible.

The US government will so kindly get his passport for him before they send him, it helps if you have his birth certificate so they can verify his identity. They will contact his home country for a temporary one time travel passport, its a paper card.

Thats what happened to my other half and it took him 2 weeks longer to get back home, they said they were "waiting" for El Salvador to send it. Still within the 90 days though, just not as fast.

We didn't provide a passport or a birth certificate so like Luis said, they will just give him a one time pass to get him to his country. No one really knows if it does in fact take longer or not, it's all a guessing game with ICE, but without any of those documents my hubby was shipped out 5 1/2 weeks into the process. Although some did get out a week and a half earlier than him, but I know that one of those didn't have any of those docs either and had been given a deportation order a month before his max out date (we got our order a year before his parole date).

I just found out that my guy will be deported to Honduras but they don't have an exact date since they just requested the passport to the consulate. He is in Louisiana and probably leave within 2-3 weeks.

The passport, green card and all that shit theyre asking for really doesnt matter. Their purpose of getting those items from you is to properly dispose of them.

No inmate getting deported will use their original passport during the process.
What the immigration office does is, they contact your embassy or counsulate to verify that said person is a national of the said country.
After this is verified they start the process of making a temporary 1 month passport for the said individual.
After that they receive confirmation and paper work from the embassy or counsulate, then its on them.
They will make flight arrangements and what not and so on and so fourth..Being that El salvador or Honduras is not that far, it shouldnt take to long, but you would have to take into consideration, the nuemerous amount of people being deported.
Even though there are massive amounts of people getting deported to the same country, they only take one inmate per plane with two US marshalls, so you can kinda get the idea why theyre pretty backed up.
But all in all people from South American countries are the fastest ones out of immigration..
