Sorry to inform you but What the lawyer said is not true , my husband had 2 years left and was transfered to Mississippi.

My husband complains about being so far and the staff, as they are so disorganized. But he likes the fact that the cells are much larger. Ive visited my husband twice already and im going back up in October. Unfortunately they do not offer fv's , you figure they would since the facility is soooo far. Anyhow, good luck i hope they dont transfer your husband to far.

Hi Ladies, I'm new to this site, and I was reading about Cali prisons transferring r guys out of state, becuz a few days ago I got a letter from my husband that said he finally got to talk to a counselor, but that this jerk wanted him to voluntarily sign to be transferred out of state, either AZ, TX, or GA...But he didn't sign. I'm still worried that they are going to transfer him out of state...what r we going to do.....His grandmother is very ill and cannot travel too far to visit him, especially out of state and I'm pregos and they are going to take him far far away from us.
I'm stressing big time... as many of you probably are too.
Is there n e thing we can do???
Any info would help~

You might be able to apply for hardship based on his grandmother. PM me. I have some information. It's worth a shot.

Default Told Out Of State

My BF Counselor @ NKSP told me that most inmates are being sent out of state because of no available beds. He has not reviewed my BF's file yet but he said if he is level 1 or 2 than most likely he will be sent to a CCF or MMF. Anything higher he would most likely be sent out of state. His release date is in July so this makes no sense. Ha anyone else heard this?

yep.
My hub just told me they told him he may be transferred also.
He is currently at cci lv2 sny.
His early out would be next yr I think nov.
how freaking STUPID is this?
I dont get to visit much at all because I work ft and have a house full of critters.
My parents DO visit fairly often....every couple of months.
Is this a reason, not many visits?
If they didnt send him so effin far down state, I would visit more often, but over 6 hrs away is too far for me.
I HATE this.

oh yeah. He told me he didnt waive his right to speak with an attny

I don't have a specific answer to your question, but I do know there is a process that is followed that does take time to accomplish. They have to be assessed, cleared medically and a few other things.
I will have to do some research on this so I can give you a more clear answer.
I have heard it is not a "quick" process.

I do know that all out-of-state transfers are on a temporary hold via a directive from Gov pro tem Brown. He wants all CA COs to be working (they have a huge union) and also there are two HUGE supreme court cases coming up in the next 2 weeks and I think the outcomes will affect the entire CDCR system.
Here's hoping!

I'm just going to put out there I hope you are getting your job to transfer you or you are self employed in a business that will allow you to continue to service your customers. I don't know what housing costs in Georgia, but here a one ROOM not 1 bedroom ONE ROOM studio starts around $650. I have been laid off a year this year. I have been a nurse for 19 years and I have 2 degrees and can't find any work.
Don't be put off by people not giving directions. It was common in Houston too. People often stay within the community where they live. If you ask someone who is at work they often go straight from work to home so they really don't know anything about the area.

Not that it matters really, but I don't think they can force you to make anything your first choice. Of course they could care less what's on that form, but I don't believe the counselor was giving your guy the right answer. My son is "in process" whatever that means, of being sent out of state as well. I wish you the best.

Yea I actually have heard that the CO's will try to mess with your head and give you false information. he is now just getting ready to be sent away it could be any day now but I have heard that the conditions are better out of state not that anything could really be better but at least it wont be freezing in Arizona like im sure it is in Susanville. Either way prison is prison and as long as his out date doesn't change then I can handle it.

Ladies, they are sending our men to Mississippi, Arizona, Oklahoma and I just read that in May 2011 Michigan is going to open a prison also. You need to check the Correction Corps of America to see all the prisons around the US. It is a private owned facility. They are going anywhere a bed is available.
