Default Traffic Tickets - he's now in jail. Who do I call?

I know this isn't in the right thread but help!?!

Ok... So my fiance has a ticket that he originally had to go to court for on July 9th. But he's been incarcerated since June 28. It wasn't till I checked his tickets on the LA Superior Courthouse website that I knew his court date was on july 9th...

Who do i call to get this fixed. I got a notice today saying that he has to pay an extra 300 fine and license suspension etc...

when my man had this in texas, i had to let him have the address of the department at the courthouse and he had to be the one to write to them....he had to send a printout from his prison unit proving he was lockedup so they would give him "time served"....the whole thing took almost a month but at least he doesn't have to stress over the ticket anymore.

look at the notice and see there's an address and get the address to your man....tell him he will need to get proof he was in lockup at the time of the court date. good luck!

yeah he's doing that right now... or rather, he's sending the paper to me so i can fill out the information and then send it back to him and then get that processed done... just what i'm worried about is that on the notice today it said "please pay within 10 days of notice otherwise we'll send it to a collections agency."

Default Cop Out sheet

Would anyone happen to have a blank cop out sheet? The cop out sheets that I sent to my fiance ... got returned to him because it was the wrong address that the website gave me. I had one lying around but I can't seem to find it and I want to try to send out the cop out sheets by monday for his traffic tickets... would anyone have a blank one that they can scan to me?

If you are dealing with traffic fines and traffic court you should try filing 41500 form to get this matter settled here is a link to a 41500 form http://calcourtforms.com/forms/ca/sier.ssc/crim-2.pdf
V C Section 41500 Non Felony Offenses of Persons in Custody Non felony Offenses of Persons in Custody


41500. (a) No person shall be subject to prosecution for any non felony offense arising out of the operation of a motor vehicle or violation of this code as a pedestrian which is pending against him at the time of his commitment to the custody of the Director of Corrections or the Department of the Youth Authority.
(b) Notwithstanding any other provisions of law to the contrary, no driver's license shall be suspended or revoked, nor shall the issuance or renewal of a license be refused as a result of a pending non felony offense occurring prior to the time a person was committed to the custody of the Director of Corrections or the Department of the Youth Authority or as a result of a notice received by the department pursuant to subdivision (a) of Section 40509 when the offense which gave rise to the notice occurred prior to the time a person was committed to the custody of the Director of Corrections or the Department of the Youth Authority.
(c) The department shall remove from its records any notice received by it pursuant to subdivision (a) of Section 40509 upon receipt of satisfactory evidence that a person was committed to the custody of the Director of Corrections or the Department of the Youth Authority after the offense which gave rise to the notice occurred.
(d) The provisions of this section shall not apply to any non felony offense wherein the department is required by this code to immediately revoke or suspend the privilege of any person to drive a motor vehicle upon receipt of a duly certified abstract of the record of any court showing that the person has been convicted of that non felony offense.
(e) The provisions of subdivisions (a), (b), and (c) do not apply to any offense committed by a person while he is temporarily released from custody pursuant to law or while he is on parole.
(f) The provisions of subdivisions (a), (b), and (c) do not apply if the pending offense is a violation of Section 23103, 23152, or 23153.

Amended Ch. 950, Stats. 1992. Effective January 1, 1993.

He can speak to his counselor and they can help take care of it. My husband had to fill out a form that basically gives him time served for any traffic tickets issued before he was incarcerated. Hope this helps. Good luck!!
