Default Post Conviction Relief ?

My son was given three 7 year consecutive sentences for residential burglary... meaning he has 21 years total on a First Offense

What are his chances to get post conviction relief?


I talked to couple of local attorneys and they say that they don't see anything to hang their hat on as a basis for the relief other than Excessive Discretion and they feel the Supreme court will deny it. I'm not sure I trust these attorneys... I feel they are all in the Judge's pocket around here.

The attorney my son had for the charges didn't do anything in the way of filing any motions whatsoever.. all he did was negotiate a plea. Unfortunately in this District everyone has to take a blind plea or take it to trial and with the blind plea you don't know how much time you're gonna get until you go before the judge. That doesn't hardly seem constitutional to me... when you give one man so much power. What if he had a bad day??

The main reason I feel the judge was so harsh was because one of the victims was the ex-mayor's mother... very much politically connected.

If she was the mother of a common brick layer he wouldn't have gotten so much time. It's just not right

Can someone please suggest an attorney that can get this done??

BTW... all of this was in Adams county, Natchez, MS

Unfortunately taking a plea is what it is. I doubt your son has a decent chance at an appeal. Any appeal can be filed, yes the attorneys will takes ones money for one, but the chances of this one being won are probably slim slim. I'm sorry to be discouraging but the attnys seem to be telling you correctly.

you may want to ask some one at a law school, a current law student to see what their opinion is ...

Here in Louisiana there are very few who will deal with PCR The only one I found wanted 15grand and couldn't guarantee anything. I will get her name in a minute she may be able to help u locate someone there.
