Question Are all phone calls recorded?

Does anyone know if all phone calls are recoreded? I am especially interested in phone calls made with Evercom Systems, Inc. prepaid calling cards that are supplied by the facilities. I know that they are monitored but are they recorded.

YES...they are. They will sometimes interrupt your call and say something to you if they dont like what they are hearing.

Yes I worked for one of the largest prison phone companies and every single call is recorded by the company. If they suspected anything foul they would call us and ask us to listen to the calls we would sit for hours listening men lie to multiple women. Demanding money name calling it was awful. I hated that job. Youde be amazed at the women who would call the prison phone service demanding to know who else"ricky" was calling or accusing US of screwing "ricky". UGH!

Even if they were not all recorded, you'd be wise to assume they are- you have absolutely, positively zero expectation of privacy.

I just sent a letter to Securus/CBS asserting my suspicions that when they terminate our calls for "No third party calls", its the DOC fault.
I believe that there is active listening and recorded calls.

Default Can phone calls made from inmate calling cards be subpeoned?

I am in need of obtaining two phone calls that were made from an Evercom calling card. My man's lawyer called the facility but they don't record any calls at all from what he was told. (I hope that is true.) I know that the pre-paid accounts record them for either refund purposes or what not. Does anyone have any information on this? Many thanks in advance.

If it doesn't say at the beginning of the call that this call may be recorded etc etc...then I don't think they are recorded. There are different laws in all the states...some are 1 party states, some are 2 party states. In 1 party states, only 1 party of the conversation has to know it's being recorded. It 2 party states, all parties have to know it's being recorded. If neither you nor your husband was informed you were being recorded then it would be inadmissable anyhow. Look into your state and find out what kind of state you are in.

The U.S. federal law allows recording of phone calls and other electronic communications with the consent of at least one party to the call. A majority of the states and territories have adopted wiretapping statutes based on the federal law, although most have also extended the law to cover in-person conversations. 38 states and the D.C. permit recording telephone conversations to which they are a party without informing the other parties that they are doing so.
12 states require, under most circumstances, the consent of all parties to a conversation. Those jurisdictions are California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania and Washington.
It is illegal under all jurisdictions to record calls in which one is not a party.
A complete state-by-state set of regulations regarding telephone call recording may be obtained in the following report published by The Reporters Committee for Freedom of the Press:

I doubt if these laws apply to correctional facilities. Its a security issue. I could be wrong, I've been wrong before.....but I don't think so on this issue.

I agree with you. Before you accept the calls it tells you they "are subject to recording and monitoring." Once you accept the call you are agreeing to the terms. I hear them on our calls all the time. It is what it is. I get to talk to my husband and that is all that counts.
