Default June 2 2010-new law about violent offenders and time served?

My fiance told me that their was a new law passed on this date stating that violent inmates in a state prison serve 65% of their time instead of 85%. Does anyone know of this law and where i can find it. If this is really true it would be a blessing to my family and it would help bring peace to my heart. My fiance was sentenced to 12years and that 65 sounds a whole lot better than that 85.

no..its supposed to have early release of nonviolent offenders..but by the time they figure out whos who..most of their time will be done. the 65 percent has been a long time rumor.

Did this ever pass or anything ever come of it? My man is doing 2 years nonviolent...was wondering if he only had to do 41 %

From my understanding and I may have to review it since it's been a while: the changes made to sentencing now state that those entering SCDC after the summer of 2010 will be required to serve 85% of their time and may not have the option of parole prior to that/at all depending on their charge. This was done to keep "violent offenders" incarcerated and to reduce overcrowding.

The "early release bill" isn't what it seems. It's just a way for many to be released within six months of their max out day, in some cases others may be release early on parole/probation if they're a nonviolent offender with no disciplinary issues within that year. I believe this is more difficult than most imagined because there is a backlog for parole agents and many already have heavy case loads.

Thanks! Ive been asking that question forever and noone knew....so, my husband is doing a 2 year sentence for a non violent charge ( traffic related) would he get released 6 months before the max out date? Is thier a website or something u get ur info from that I could print out and send to him, I cant find the early release bill anywhere, much less see if it passed (did it pass for sure?) Or tell him if it applies to him.....thank u so much for the info! U may have just made my day...month...year!

And my son was sentenced as a violent offender August of last year. his is definitely 85%. Just sux.

I do believe he is able to earn credits to decrease his sentence GailSC even with the 85% rule. I have to review the bill again. We have been trying to figure this out since he went back. But now SCDC has his dates messed up and have not credited him for time serves so what do you do???

Gosh, that would be a God send, but I can't get past the judge saying "do you understand you will have no option but to complete 85% of this sentence and parole is not an option?". For a first time offender where no one was hurt or touched or anything....just breaks my heart.

I know that feeling so well, but I believe in the notion that there's always another way. It was our impression as well due to all of the changes (sentencing) since he first entered SCDC. But after reading the legislation and him asking questions there is another way without parole being an option. Best wishes to your and your son.

Do you have a link to the legislation? I've searched but can't find anything. I'd love to read it over and see there are possibly any loopholes we may be overlooking. If you don't do these things for yourself, nobody will do them for you! (especially your lawyer!)
