Default Oklahoma Probation - Early Termination in NY

I received 3.5 yrs probation after my release on a 1.5yr sentence. I had my probation transferred from OK to NY.

NY does not have any unsupervised probation and they limit you to the County you are in rather than the state. They also do not have any early termination. It's pretty strict all the way around but I wanted to be back home near my family to get back on my feet.

My probation officer said that Oklahoma retains the right to end my probation early if they wish.

I had 0 incidents in prison and excellent reviews while completing any classes offered and passing all piss tests. No write ups at all.

I have a full time job and a part time job and have been in no trouble. I am doing everything right and have the money to pay off my $6000 worth of court fees.

I am wondering what steps I can take to have Oklahoma terminate my probation if I pay all my fines off.

I am a productive and educated member of society, own a home, car, 2 jobs, no trouble. I really don't want to have to stay on probation for 3.5 years. My probation officer agrees that he would support termination of my probation if Oklahoma would allow it. He is going to try contacting them in Sept to see what they say.

Any tips?

You can File a Motion for Termination Probation. You can get a standard form from your PO or the clerk of the court where you were sentenced to probation. There are steps, before you file though. You do need to check with your PO though and make sure you are on the right track to do so. Meeting your sentencing requirements, fullfilling any fines/fees, etc. Hope this helps and good luck!

That's great that your PO is willing to support you with this possible termination. Would make it easier on the judge who would hear the Motion, knowing your PO gave positive feedback.

Thanks turbo. Any info is appreciated.

I will have to contact them in OK about the form. I am just trying to get as much together as I can to make this go smoothly.

My PO is writing/contacting/emailing them the first week in Sept to find out what the process is and what needs to be done. I am just trying to take as much initiative as I can to move the process along smoothly.

I have given a letter of intent to my PO and he said he will contact Oklahoma the first part of Sept. to start working on it and see if they will terminate it.

I heard back and they said I would be eligible for early termination after 2yrs of probation.

So they mandate that you serve 2 years of probation through OK before you can have it terminated no matter how long it is. That's better than never.

Sorry that you couldn't get it terminated sooner...BUT...let's look at it this way:
That's awesome, 2 years is better than 3.5!!
ANY "reduction" from the time you originally expected is a blessing.
And considering you have a job, ect, I'm thinking they will probably let you go as soon as those 2 years are up!
