Default What happens if he was on parole already??

no one seems to have any answers for me, but Im wondering what happens if he was on parole already when he got arrested? What happens to the parole? Can they make him do the whole parole sentence too?..
ugh, stressin..

That depends on if he's found guilty. If I understand you correctly, it's just a parole violation. If he's found guilty he will just have to complete what's left of his remaining sentence. If he commited a different crime, and he's found guilty, he will have to do more time. I hope I helped and pray that all goes with for you.

He was already sentenced on his new charges. And they haven't violated him yet, he's been in prison.for months. His parole that he was on before prison doesn't end until 2016.. but his release date is scheduled way before that. So that's why im worrying. I don't him to have to stay there until then when he's suppose to get out sooner.. :/

That's unusually because he should've been seen by DPP prior to him being sentenced for the new charges, because that's a violation of the terms of his parole. If they decided not to pursue the violation and dismissed it, then he will only have to complete his time (2016). Someone should've have told him that already, and he should have paperwork regarding it.

Sounds like u got lucky and noone caught it, or they decided not to pursue a violation of parole on him. The parole violation is a seperate charge and he would have to go to court for it, then like other times, its up to the judge what he actually gets sentenced to. The dpp should have contacted u before or during the trial...with a violation. Does he report to his parole officer monthly or anything? If it was overlooked (and that does happen) it will very likely come uo when he misses an appt or payment. Is he still in r&e or county jail? If so it may come up during his time at r&e. If he makes it to a yard without it coming up he should be ok, unless his current sentence has probation attatched to it, at which point the dpp would get his release case and most likey catch it. Knowing for sure whats going on would nake u feel better, and im sure u coud call and get to the bottom of it, but id be scared to try it....God bless u...the worry would drive me insane

He is already on his yard. And I have called up there and they basically tell me that its up to his parole officer to send the paperwork. I have even gone to talk to his parole officer myself and ask him what was up.. so I know that he is aware. But my concern is that they would make my fiance stay in prison until his parole is up... He says that they cant do that. But other people say that they can..

I have to agree with those who say the parole agent can make him do the time. If I understand you correctly, you seen him and asked about it, and your loved one wasn't contacted about it being revoked or what not before he went to SCDC, he may have to do whatever time he had left on parole as well.

Unfortunately he violated the terms of his parole by getting another charge and more time. All of that was explained in the paperwork he had to sign for his parole agent the first day he reported.
