NeverDull,

Did your man get any jailtime? Or was he automatically ordered deported after getting his conviction?

I would think he would have gotten jail time for aggravated felony, no? Don't all aggravated felonies carry jail time? Just guessing..... so sad that people can spend a whole lifetime in the US and in one moment be kicked out of the country.... sad and scary!!!

Yes, he is serving an 18 month Federal sentence. He technically hasn't been ordered deported yet. After he serves his sentence he will automatically go back to Immigration Detention and be processed. From what I've read lately if you have been convicted of an aggravated felony (which his bank fraud is considered) then they don't even have to give him a hearing but can just automatically deport him with a lifetime ban.

It's kind of scary how "aggravated felony" was originally intended for crimes like murder, rape, armed robbery....but now Congress keeps adding to the list of crimes and a whole host of non-violent crimes (like bank fraud or wire fraud) are now called aggravated felonies and can be used to deport people. I had NO IDEA about any of that before!

So sorry to hear. My man was already in ICE custody, was ordered deported, and then an warrant from FL came up under his name, and they had to cancel his plane ticket, and send him down to FL to face charges. He's almost done with the state charges, for retail fraud, and will be going back to ICE to directly get deported. I hope it's not a lifetime ban for him

ICE initially picked up my man too (with some other people as well) but the FBI and Homeland Security were also there. It was easier to snatch them up on visa issues first to hold them and try to interrogate them without pressing criminal charges first so they didn't have a right to public defenders first to see if they would talk (nice way to try and skirt around their rights to legal representation). He was there for 2-1/2 weeks before being charged and moved to Federal detention so he didn't have an immigration hearing prior to the criminal charges...he will go back there once his sentence is done. Such a mess. What country is your man going to be deported to? I hope he will be able to avoid a lifetime ban too. How much longer does he have to serve?

Wow, I'm sorry to hear that. That had to be really tough on you guys. Imagine us, we went through all the court procedures, they did his travel permit since his passport was expired, bought the plane ticket, and then BAM. Cancelled everything, and sent him down to FL from NJ. My man is going back to Romania. Yours?

Wow that sucks. Mine is from Moldova...basically Romania. So what r u going to do? My man says Moldova would be a terrible country for me to live in. Ugh!!! I'm gonna PM you cuz I have questions on how they were going to send him back.

Yes I'm American and only speak English. Sigh. What about you? And where in Romania are you going? I remember a long time ago we were in a bookstore and he took me to the travel section and we were looking at books about Romania and he was telling me he wanted to take me there to visit for about a month, how much I would love Bucharest, etc. it makes me soooo sad to think he will never be able to come back here again. Are you scared to move there? Have you ever been there before?

I am actually Romanian too, but have been in the states for 18 years. Came when I was only 9. When we go back, we will be living in Bucharest because my husband has an apartment there. It's a beautiful city. Lots of history. But like any other big city, it's pricey to live there. I am pretty scared to move because it'll be a culture shock again, even though I used to live there. It'll be just so different for me and my son (who's fixing to turn 2). I think you guys should consider Bucharest if your man wants to!

Yea my husband is currently doing time ( exactly a year) just for carrying a weapon, and for them thats a felony..
