Default Temp release for state bench warrant tdcj

If he leaves tdcj to serve a state bench warrant in a county jail does he go back to tdcj ?

He'll go back to TDC once the reason for the bench warrant is disposed of.

Yes, he will go back. Something he might want to consider is having TDCJ store his property though. I cannot remember how long they will store it for, but it should be there when he gets back. My reason for mentioning this is that although diag usually allows the property they left with to come back, every now and then you might run into the CO who will not allow it. Anyway, this is just some food for thought.

short answer is that he may or he may not. Depends on what the bench warrant was for.

PIA releases from county jails take place on a daily basis.

There are some inmates who get benched back on a little-used provision that allowed them to serve out the sentence in a county facility when they had a legitimate value to the county due to a skill-set that could be used by the County.

The problem with being in county for the balance of a sentence is that the Board cannot consider ANY of hte FI-R programs. It is then only an FI-1, FI-2 or denial if the parole vote is the one being contemplated.

He had class c misdemeanor for assault causing bodily injury

I don't that being something they would keep him in county jail for. Depending on how long it takes to resolve the case, he could go back directly to where he was previously housed OR he will come back in on a regular chain and go through intake again.
