Default What happens if the respondent fails to file their brief?

Hey were supposed to file it last week. I've been checking and today it finally says they are being notified that they failed to file. What does this do to the appeal? What could happen next? I am really thinking that they will be granted an extension but I'm unsure. Is this common? Thanks!

They'll probably ask for and get an extension.

Thank you. They turned it in 4 days after the notification. But now it says oral argument waiver notice sent. What is this and why would they waive it?

It means they'll submit on the written documents and not ask to personally appear and argue the issues. That's what is usually done.
