Red face Intro--tosh from California

hello, my name is tosh, im 26 and live in southern cali.
i've been in a relationship with an inmate named jason for years now, he's actualy 10 years my senior and was locked up at the age of 16. we meet via my cousin who was his cell mate for 5 years. wish i had known this was here before.... im not sure what to say... i do have a question if someone can help that would be great. my question is how can he get a divorce if his "wife" is in france and wont sign the papers?

Hello! Welcome to prison talk I am going through the same thing with my guy he is legally married and his "wife" lives in another state. He spoke to the people at the law library at the prison he is in and they are going to get him started on the process. As far as the "wife" having to sign papers im not sure how that goes I wish I knew myself =/

wow thank you to all! i wasnt really expecting so many welcomes. have to say i just got all emotional, ive never had anyone understand what i have been and am going through being in love with an inmate. i feel like i belong here.

I don't have many more answers than the other women who have already posted. But i BELIEVE i have heard that if the other party won't sign papers, you have to petition the court to grant the divorce anyway. Not sure how that works while in prison, or while the other party is out of the country. Sorry I couldn't be much more help.

Not sure if it works the same for those who are currently incarcerated, but my mom and I were just talking about this the other day as she saw it on televsion LOL People who can't get their spouses to sign papers or have no method of contact can also post an add in the newspaper for notice of intent to divorce or something and it is considered the same thing as them being served and the process goes from here...again i am not 100% sure of this but maybe worth googling...

I wish I could help with the divorce! I can tell you now that it's difficult enough with a domestic divorce. My Brandon doesn't even want to deal with it (He's on the inside and plans to divorce the Hell wife as soon as he's out.) now because it's such a difficult process. There are boards for things like this, I believe, so maybe you could find something on there.

Welcome to PTO. In California you file the papers and make the reasonable effort to serve the papers (the court will tell you what you have to do). If the party once served doesn't respond with in thirty days you file a legal form stating that the divorce is a default divorce. There are other declarations that need to be filed as well regarding finances and community property etc. File all the paper work. In CA the wait is 6 months and 1 day from the date of filing for you to request final judgement. You request that the judgement is entered and divorce is complete. Most of the CA counties have pretty good information on their web sites as to how to proceed and links to print out paper work. Good luck.
