Default 1-2 years sentencing, so he says

I'm not quite sure what to believe as I'm all new to this. My husband was in County for 2 months and then told me he was sentenced to 1-2 years. He told me the DA and judge said he would be out in 10 months. Since County only keeps them if they are sentenced to 23 months or less He was moved to state. My firend says he is not being totally upfront with me and that if he went to STATE he will not be out in 10 months, now 9 months. I never received any sentencing papers in the mail (he just told me the info) just fines imposed were rec'd in the mail. Is it true about STATE? What do I do from here? I don't have ph privelages w./ him as yet and don't want to write him about this. I do have a docket # & court summary from the internet, calling his DA in the morning.

depending on his offense he only has to serve a certain amount of the sentence.it varies from 50%,65% or 85%. then you factor in his good time credits, work credits, and the time he served in county also counts towards his time. So yes he could be home in 10 months

This is your best option. Parole guidelines vary by state, if you are unable to decipher your state's guidelines (once you look up the inmate information) you can ask the question on the PA forum. A great example - GA parole consideration begins at 1/3 or 9 months whichever is greater for a lot of crimes however GA does not award good time for state inmates.

Good Luck
