Default Violent Felony Override

I have a question. how long would an inmate have to be locked up for to even try to apply for VFO. My husband is at a max prison and his crime is classified as a violent crime. He got 12 yrs flat for manslaughter in the 1st. this is his first and last but he has no priors on this crime. is he or will he be eligible? he was locked up since 2008 for a drug charge which he got 3 yrs for and maxed out for it in 2011. he got sentenced 3/12/12. the judge said his time already served is to run concurrent with this new commitment. i already know about the 85% rule thats not my question? SOMEONE WHO KNOWS THE CORRECT ANSWER TO THE VFO PLEASE REPLY. THANK YOU

no he would never be eligible for a VFO. VFO is for crimes in which there was no violence. Burglary is usually the crime in question. Burglary is classified as a violent crime-but there are many times where no violence nor weapons are used. These are 99% of the cases where a VFO can be granted.

With manslaughter, there is simply no way. Sorry.
